General terms and conditions of sale
Article 1 – Contractual Relationship
1.1 – These General Terms and Conditions of Sale (hereinafter « Terms and Conditions »" are applicable to any ticket purchase made by a natural or legal person (the "« customer »" with Michaël Berthoud or Marie Mellioret (hereinafter the "’ organizer » or the “seller“) by any means whatsoever.
1.2 – The customer is invited to carefully read the General Terms and Conditions which aim to define the contractual relationship between the customer and the organizer, as well as the conditions applicable when purchasing tickets and products online or at the ticket office.
1.3 – The language of these General Terms and Conditions is French. In the event of a translation of all or part of these conditions, only the original French text shall prevail.
1.4 – Confirmation of the order by the customer constitutes the conclusion of the final contract. This implies the customer's unreserved acceptance of all the General Terms and Conditions of Sale, which they acknowledge having read prior to validating and/or paying for their purchase. The customer accepts the provisions concerning security and any additional regulations relating to access to the venues or any other performance location.
1.5 – The customer has acknowledged that if these regulations are not respected, they will be refused access to the event.
1.6 – The applicable Terms and Conditions are those in effect on the date of the order or purchase of the ticket. The organizer reserves the right to adapt or modify these Terms and Conditions at any time and without prior notice, to the fullest extent permitted by law.
Article 2 – Ticket prices and regulations
2.1 – Electronic ticket prices are indicated in CHF including sales fees.
2.2 – All orders placed from the organizer's website are payable only via the Internet (see Art. 3).
2.3 – The customer receives an order confirmation immediately after purchase. Without a confirmation email, the order may not have been processed. For events, participation will not be possible if the order has not been finalized.
2.4 – The organizer reserves the right to change its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of the order and the customer is informed of these before confirmation and conclusion of the final contract.
Article 3 – Payment via the internet
3.1 – Payment methods are limited to the following credit cards: Visa, Mastercard and other credit cards via the provider Stripe, as well as PayPal.
3.2 – The organizer has entrusted its online payment system to Stripe and PayPal, specialists in securing online payments. This provider guarantees the complete confidentiality of the customer's banking information, secured using the SSL protocol, which systematically verifies the validity of access rights when the customer pays by credit card and encrypts all exchanges to guarantee their confidentiality.
Article 4 – Order Confirmation
4.1 – When the customer ticks the box «I have read, understood and accept these terms and conditions» and clicks on «validate» when choosing the payment method, the customer declares that they accept these terms and conditions without reservation.
4.2 – The order is definitively registered when the customer has accepted the terms and conditions, validated their payment and received an email confirmation from the organizer.
4.3 – In the event of a payment rejection by the payment centre, the booking and purchase transaction is automatically cancelled.
4.4 – All reservations and purchases are firm and final: no cancellations or modifications will be possible once payment has been confirmed.
Article 5 – Cancellations
5.1 – A ticket or the purchase of a good or training course on the shop cannot be returned, exchanged or resold.
If the customer cannot attend an event, they will have to find a replacement themselves.
5.2 – The organizer reserves the unilateral right, at its sole discretion, to modify the program, or if the conditions are not met to ensure the smooth running of the planned activity. These changes do not entitle participants to any refund.
5.3 – The following cases entitle the customer to a refund of tickets:
- Definitive cancellation of an activity due to the organizer and solely attributable to the organizer.
In these cases, the customer must send a ticket refund request by email to the organizer at [email protected] Please provide your order number and bank details within one month of the expiry date. No refund requests will be accepted after this period.
The organizer cannot be held responsible if the email address provided contains errors.
5.4 – The client understands and accepts that the organizer will not be held liable in the event of «Force Majeure», i.e. any exceptional event beyond the reasonable control of the organizer, which would prevent it from fulfilling its obligations under these Terms and Conditions, such as wars, civil wars, strikes, shortages of raw materials, terrorism, unavailability of essential equipment, significant damage to or destruction of infrastructure by fire, earthquake, severe storm, hail, storm or hurricane, epidemics, pandemics, endemic crisis, government restrictions and/or prohibitions and failure of public services or public transport.
In these cases, the organizer may, at their sole discretion, consider a request for a ticket refund from the customer. To do so, the customer must send a refund request by email to the organizer at [email protected] by providing the order number and the numbers of any unused tickets. The organizer undertakes to review each refund request and decide on a case-by-case basis. The organizer reserves the unilateral right, at its sole discretion, to determine an alternative solution, such as postponing a concert and allowing the customer to reuse the tickets purchased.
The organizer cannot be held responsible if the email address provided contains errors.
5.5 – If the organizer decides to refund tickets, only the price indicated on the ticket will be refunded. If the ticket has been personalized by the customer for the holder without a price category, for example with the mention "Free Ticket," "Gift Ticket," or "Invitation," the customer should refer to the amount paid on the booking invoice and, if necessary, contact the organizer.
Article 6 – Postponement of activity
6.1 – Field trips (3-hour classes held exclusively outdoors)
In the event of non-participation due to illness, accident (with presentation of proof), or close bereavement, field trips may be postponed to a later date (maximum 2 seasons).
We only accept one additional place beyond the maximum number of participants to accommodate a postponement. The choice of date is at the organizer's discretion.
6.2 – Courses and workshops with a given portion indoors
In the event of non-participation due to illness, accident (with presentation of proof), or close bereavement, it is possible to make up the course with workshop at a later date, only if there are still places available 2 days before the desired date (maximum 2 seasons).
It is the participant's responsibility to contact the organizer to check if there is a free place.
Article 7 – Weather
7.1 – The course takes place in all weather conditions, even rainy ones.
7.2 – If the weather is stormy and particularly bad, the course is cancelled. It is systematically cancelled when the storm severity level reaches 3/5 according to MeteoSwiss. To avoid unnecessary postponement, the organizer makes the decision the day before or even on the day of the course. The client will be contacted by SMS and email.
The organizer cannot be held responsible if the email address provided contains errors.
7.3 – In case of cancellation due to weather, the course will be refunded, exchanged for another date or given a gift voucher.
Article 8 – Covid and health pass
8.1 – In the event of cancellation of an activity due to a state health obligation, the course is postponed if possible, but a refund is possible in the form of a gift voucher.
8.2 – For activities with an indoor part, if the course is maintained and a health pass is required by the State (3G or 2G… depending on the obligation at the time), and the client cannot present a valid health pass, the cancellation conditions still apply, namely that no refund will be possible.
8.3 – By registering, the customer accepts that these conditions may change due to the pandemic between the time of your purchase and the date of the course.
Miscellaneous
Dogs are not allowed for hygiene reasons.
Article 9 – Online Training
9.1 – Access to online training courses is guaranteed for a minimum of 1 year. After this period, access is still possible, but without guarantee and may be cancelled at any time.
Article 10 – Virtual Products
10.1 – When purchasing a digital product (calendar, glossary), the customer receives an email containing links to download the files. The customer can download the files again by... logging into his account.
The seller cannot be held responsible if the email address provided contains errors.
10.2 – Download links are functional as long as the seller's shop exists. The seller may remove products or links at any time, without giving notice or reason to the customer.
Article 11 – Online Shop
This article applies when purchasing physical products.
11.1 – Availability
Our delivery commitment is void in the event of failure or delays in supply from our own suppliers, provided that this unavailability is not attributable to the seller. In the event a product is unavailable, we will inform you as soon as possible.
11.2 – Delivery and transport
Available items are shipped via postal service within approximately 10-15 days. A shipping fee is charged only once per order.
PLEASE NOTE: The seller does not deliver parcels to post office boxes and does not deliver any merchandise to minors or customers under guardianship, except with written authorization from parents or guardians.
Delivery is only possible in Switzerland.
11.3 – Return or exchange of goods
Items must be returned undamaged and complete in their original packaging (with labels bearing their references), along with the delivery slip, within 7 days of receiving the package. Return shipping costs are your responsibility. Refunds will be issued within 10 days of receiving the returned item, to the original payment method.
11.4 – Legal Guarantees
Check the condition of the delivered goods immediately to rule out any obvious material or manufacturing defects, as well as any damage caused during transport. In accordance with the law, you are obligated to notify us of any defects or anomalies affecting the delivered goods so that we can remedy them.
11.5 – Price
The prices in this catalogue are indicated in Swiss francs or euros, net amounts, including VAT and guaranteed.
Items under warranty are subject to the terms of the offer valid at the time of purchase. The warranty takes effect on the date of delivery, as evidenced by the accompanying document (invoice), which we ask you to keep carefully. The following are not covered: damage due to improper maintenance, failure to follow the instructions for use, or normal wear and tear.
Article 12 – Data Protection
All personal data will be treated as confidential. Information necessary for order processing will be processed electronically and may be shared with partner companies for order fulfillment purposes.

Article 13 – Applicable law and jurisdiction
The applicable law is Swiss law, and any dispute will be dealt with by the District Court of Lausanne.
